Scarlett Terms of Use

These Terms of Use (“Terms”) govern your access to and use of the online mortgage application services provided by The Mortgage House Inc., and all affiliate brands powered by The Mortgage House Inc. (“we”, “us”, “our”). The Mortgage House Inc. operates as an independent mortgage brokerage utilizing the Scarlett Network platform under license from Axiom Innovations Inc. By clicking a box indicating your acceptance, accessing or using our online application or related services (collectively, the “Services”), you agree to be legally bound by these Terms and all applicable laws and regulations.

If you do not agree to these Terms, you must not access or use the Services.

1.           DEFINITIONS

For the purposes of these Terms:

a)        “Application” means the online mortgage application system made available by The Mortgage House Inc. through the Scarlett Network platform.

b)        “Brokerage” means The Mortgage House Inc., a licensed mortgage brokerage operating in multiple Canadian provinces.

c)        “Client Data” means personal, financial, and other information you provide when completing a mortgage application through the Services.

d)        “Personal Information” means any information that identifies or can reasonably be used to identify an individual, as defined by applicable Canadian privacy laws.

e)        “Privacy Laws” means all applicable federal, provincial, and local privacy legislation, including but not limited to the Personal Information Protection and Electronic Documents Act (PIPEDA) and provincial privacy acts.

f)           “Services” means the online mortgage application tools, forms, and related services made available by The Mortgage House Inc.

g)         “You” or “Your” refers to the individual or entity accessing or using the Services.

2.           THE SERVICES

The Services allow you to securely submit mortgage applications and related financial information to The Mortgage House Inc. for the purposes of obtaining mortgage financing. The Mortgage House Inc. uses the Scarlett Network platform (powered by Axiom Innovations Inc.) to facilitate the secure transmission, processing, and storage of Client Data.

You must be at least 18 years of age to use the Services.

3.           PRIVACY POLICY

Please refer to our Privacy Policy for information about how The Mortgage House Inc. collects, uses, and discloses your Personal Information. By using the Services, you consent to the collection, use, and disclosure of your information as described in our Privacy Policy.

4.           ACCOUNT SECURITY

You may be required to create an account or otherwise provide authentication information to access certain features of the Services. You agree to:

a)        Provide accurate and current information;

b)        Maintain the confidentiality of your account credentials;

c)        Notify us promptly of any unauthorized access or use; and

d)        Accept responsibility for all activity that occurs under your account.

5.           USE OF SERVICES

You agree to use the Services only for lawful purposes and in accordance with these Terms. You may not:

a)        Use the Services for any unlawful or fraudulent activity;

b)        Attempt to gain unauthorized access to the Services or related systems;

c)        Upload false, misleading, or incomplete information; or

d)        Interfere with the proper functioning of the Services.

The Mortgage House Inc. reserves the right to suspend or terminate your access to the Services for any misuse or violation of these Terms.

6.           OWNERSHIP AND LICENSE

All content, trademarks, and intellectual property within the Services are owned or licensed by The Mortgage House Inc. or Axiom Innovations Inc. You are granted a limited, non-exclusive, revocable license to access and use the Services for personal, non-commercial purposes related to your mortgage application.

You may not reproduce, distribute, or create derivative works from any part of the Services without prior written permission.

7.           YOUR DATA

You retain ownership of all Personal and financial data you submit. By submitting data, you grant The Mortgage House Inc. and its service providers the right to process, transmit, and store your information as necessary to provide the Services. We will maintain the confidentiality of your data and will not sell or disclose it except as permitted under applicable law or as necessary to complete your mortgage application.

8.           DISCLAIMERS

The Services are provided on an “AS IS” and “AS AVAILABLE” basis. The Mortgage House Inc. makes no representations or warranties of any kind, express or implied, regarding:

a)        The accuracy or completeness of information on the platform;

b)        Continuous or error-free operation; or

c)        The suitability of the Services for your specific circumstances.

We are not responsible for any technical issues, service interruptions, or damages resulting from use of third-party platforms such as the Scarlett Network.

9.           LIMITATION OF LIABILITY

To the fullest extent permitted by law, The Mortgage House Inc., its affiliates, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or revenue, arising out of or related to your use of the Services.

10.     TERMINATION

You may discontinue use of the Services at any time. The Mortgage House Inc. may suspend or terminate access to the Services at its discretion, including if it believes you have violated these Terms or any applicable laws.

11.     GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the Province of Alberta and the laws of Canada applicable therein. Any dispute arising from these Terms shall be brought before the courts of Alberta.

12.     MODIFICATIONS

The Mortgage House Inc. may update these Terms from time to time. Any changes will be posted on our website and reflected by the “Last Updated” date above. Continued use of the Services after such changes constitutes your acceptance of the revised Terms.
